Tracy Wintermute, 21, New Straitsville Rt 1, was dead on arrival at Hocking Valley Hospital after an apparently accidental shooting early Friday evening at the Stage Coach Inn, 225 E. Main St. City police said the fatal shot was fired by Gene Thompson, 23, of near Gore, a brother-in-law of the victim. Prosecuting Attorney Forrest Moore filed a manslaughter charge against Thompson this morning. Thompson, represented by attorney Hubert Lappen, waived a reading of the charge in county court and Judge Vaughn Collins set bond at $1,000. The defendant was remanded to county jail pending payment of bond. The defendant will appear before Judge Collins at 10 a.m. Monday to enter a plea to the charge. The shooting occurred shortly before 6 p.m. in the sales room of the Stage Coach Inn. Owner of the .22-caliber used is Max Matheny, 127 Freisner Ave., an attendant at the service station, police reported. Preliminary investigation indicated only one shot was fired, which struck the victim in the left side. Thompson took Wintermute to the hospital in his pickup truck but he was dead when they got there, police reported. The two men , who were partners in a Texaco service station at Nelsonville, came to the Stage Coach Inn together-one to return some tools and the other to pay a bill, police said. Thompson had previously worked at the Stage Coach. Thompson told police the shooting was accidental. Authorities were able to put together the following story from his statements: Thompson thought the revolver shot only blanks, as a similar blank gun had been kept at the station when he worked there. The gun was in a box under some merchandise. When Thompson picked up a package of cakes, he noticed the gun and picked it up. He said he turned and fired the gun with the intention of scaring his brother-in-law.
Wintermute was born March 3, 1944, at New Straitsville, the son of Ida Jones Wintermute Perrin of New Straitsville and the late Ezra Wintermute. He was a member of the Mt. Zion EUB Church, New Straitsville.
In addition to his wife Carolyn Sue Thompson, He is survived by a son Tracey Lenn II; two brothers, Dean and Larry Wintermute, both of New Straitsville; two half-brothers, Stephen and Randy Perrin, both of New Straitsville, and a half-sister, Pam Perrin of New Straitsville.
Funeral services will be held at 10 a.m. Tuesday at the Leonard Funeral Home, with the Rev. Willard O. Drefke officiating. Burial will be in Oak Grove Cemetery. Friends may call at the funeral home at 7 p.m. Sunday.
